Terms of Use and Terms of Service

These Terms of Use and Terms of Service ("Terms") are issued by NurseNet Asia (M) Sdn. Bhd. (SSM 202501028075 (1629487-D)), with its registered address at T3-13A-11, Icon City, Jalan SS8/2, Sunway City, 47300 Petaling Jaya, Selangor DE, Malaysia. Official correspondence may be sent to info@nursenet.my.

These Terms are governed by the laws of Malaysia. Any dispute arising out of or relating to these Terms or the NurseNet platform shall be subject to the exclusive jurisdiction of the Courts of Kuala Lumpur, Malaysia. This document is version 1.0, effective 8 May 2026, published in English.

In preparing and operating the Platform, NurseNet takes into account applicable regulatory and industry references, including without limitation:

  • Personal Data Protection Act 2010 (Malaysia)
  • Consumer Protection Act 1999 (Malaysia)
  • Contracts Act 1950 (Malaysia)
  • HRD Corp / PSMB Guidelines
  • Malaysian Ministry of Health myCPD Framework

Introduction

These Terms & Conditions ("Terms") govern the access to and use of the NurseNet platform, services, educational content, memberships, events, certifications, and all related products and services operated by NurseNet Asia (M) Sdn. Bhd. By accessing, browsing, registering for, purchasing from, or otherwise using the platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.

Definitions and Interpretation

1.1Definitions

Platform
Refers to the NurseNet website, applications, systems, digital services, and all related infrastructure.
User
Any person accessing or using the Platform.
Member
A registered User with an active NurseNet membership.
Course
Any educational, training, webinar, workshop, or CPD-related offering provided through the Platform.
Session
A scheduled delivery instance of a Course.
Certificate
A document issued by NurseNet confirming participation or completion.
Voucher
A promotional, compensatory, or administrative credit issued by NurseNet subject to its own conditions.
Speaker
An independent contractor, trainer, facilitator, or presenter engaged by NurseNet.

Eligibility and User Accounts

2.1Eligibility

Users must provide accurate, current, and complete information during registration and use of the Platform.

2.2Account Responsibility

Users are solely responsible for safeguarding their account credentials and activities conducted under their account.

2.3Single User Access

Accounts are strictly personal and non-transferable. Sharing accounts, login credentials, attendance links, or platform access with third parties is prohibited.

2.4Fraud and Misrepresentation

NurseNet reserves the right to suspend, restrict, investigate, or terminate any account suspected of fraud, impersonation, certificate misuse, abuse, intellectual property infringement, or violation of these Terms.

Memberships

3.1Membership Structure

The first one hundred (100) eligible users may receive complimentary membership access at NurseNet's discretion. Thereafter, membership renewals are priced at RM19.99 per year unless otherwise revised.

3.2Membership Benefits

Membership benefits may include discounted course pricing, downloadable certificates, access to member-only content, early feature access, educational resources, job consultation initiatives, locum opportunities, and other future services.

3.3Modification of Benefits

NurseNet reserves the right to modify, remove, suspend, or introduce membership benefits at any time without prior notice.

Courses, Sessions and Educational Services

4.1Educational Nature

All Courses and Sessions are provided for educational and professional development purposes only.

4.2No Clinical Guarantee

NurseNet does not guarantee clinical competency, employment outcomes, promotions, licensing approvals, CPD recognition outcomes, or professional advancement.

4.3Right to Modify

NurseNet reserves the unrestricted right to modify course titles, schedules, pricing, materials, speakers, formats, delivery methods, availability, or educational content without prior notice.

4.4Session Cancellation

Sessions may be cancelled, rescheduled, postponed, or replaced at NurseNet's discretion for operational, safety, technical, educational, or commercial reasons.

Payments, Pricing and Platform Fees

5.1Currency

All pricing displayed on the Platform is denominated in Malaysian Ringgit (RM).

5.2Platform Fee

A platform processing fee of up to ten percent (10%) may be applied to eligible purchases and shall be disclosed during checkout.

5.3Pricing Changes

NurseNet reserves the right to revise pricing, fees, discounts, promotional offers, or commercial structures at any time without prior notice.

5.4Payment Finality

All successful payments are considered final and non-refundable except where explicitly stated under NurseNet's Refund & Cancellation Policy.

Voucher Policy

6.1Voucher Variability

Different vouchers may carry different eligibility rules, expiry structures, redemption conditions, usage limitations, category restrictions, and operational requirements.

6.2Cancellation Compensation Voucher

Where NurseNet cancels an eligible Session, NurseNet may issue a replacement voucher redeemable for one (1) Course within the same category and CPD value, subject to availability.

6.3Voucher Restrictions

Unless explicitly stated otherwise, vouchers are non-transferable, non-redeemable for cash, and may not be resold.

Attendance and Participation

7.1Attendance Requirement

Users must attend at least eighty percent (80%) of the official Session duration to qualify for certification eligibility.

7.2Attendance Verification

Attendance may be verified through automated systems, digital logs, access records, timestamps, platform analytics, engagement indicators, or other operational methods determined by NurseNet.

7.3User Technical Responsibility

Users are solely responsible for ensuring stable internet access, suitable devices, audio functionality, and technical readiness during participation.

7.4Technical Failure Limitation

NurseNet shall not be liable for participation disruptions arising from user-side technical issues including poor connectivity, device failure, browser incompatibility, or environmental interruptions.

Certificates and Verification

8.1Certificate Issuance

Certificates are generally issued within twenty-four (24) to forty-eight (48) hours after successful completion verification, although issuance timelines are not guaranteed.

8.2Certificate Security

Certificates may contain unique identifiers, hashes, verification references, QR validation systems, or anti-fraud mechanisms.

8.3Certificate Ownership

Certificates are personal, non-transferable, and intended solely for the eligible User.

8.4Forgery and Misuse

Forgery, manipulation, unauthorized alteration, misrepresentation, or fraudulent use of certificates may result in account termination, reporting to relevant authorities, legal action, or permanent restriction from the Platform.

8.5Certificate Reissuance

The first certificate issuance is complimentary. Reissuance requests may incur an administrative fee of RM5 per certificate.

CPD and myCPD

9.1myCPD Relationship

CPD points are issued through the Malaysian Ministry of Health's myCPD framework and remain subject to the policies, systems, review procedures, and approvals of the relevant authorities.

9.2No Guarantee of Recognition

NurseNet does not guarantee acceptance, approval, recognition, transferability, or applicability of CPD points by employers, regulators, licensing authorities, educational institutions, or professional bodies.

HRDC / PSMB Compliance

10.1Training Provider Status

NurseNet operates in accordance with applicable HRD Corp, PSMB, and Malaysian Skills Agency-related operational requirements as a registered training provider where applicable.

10.2Claimability

Course claimability, reimbursements, grants, or employer-sponsored approvals remain subject to HRD Corp policies, employer discretion, funding conditions, and regulatory approval processes.

10.3Claim Rejections

NurseNet shall not be liable for rejected, delayed, partially approved, or disputed HRDC or employer claims.

Intellectual Property and Content Protection

11.1Ownership

All materials, recordings, text, graphics, slides, course structures, educational frameworks, designs, branding, logos, videos, software, downloadable resources, and content remain the exclusive intellectual property of NurseNet and/or its licensors.

11.2Unauthorized Use

Users shall not copy, reproduce, redistribute, republish, upload, modify, screen-record, livestream, commercially exploit, resell, or otherwise misuse any content without prior written authorization.

11.3Social Media Restrictions

Users shall not publish misleading, defamatory, unauthorized, edited, out-of-context, or reputationally damaging content relating to NurseNet, its Speakers, courses, systems, or Users.

11.4Enforcement

NurseNet reserves the right to pursue enforcement actions including suspension, takedown requests, legal proceedings, damages claims, reporting to authorities, or injunctive relief.

AI-Assisted Content Disclaimer

12.1Use of AI Tools

NurseNet may utilize artificial intelligence or AI-assisted systems for educational enhancement, automation, personalization, operational support, analytics, drafting assistance, or content generation.

12.2Potential Inaccuracies

Despite reasonable review efforts, AI-assisted content may contain inaccuracies, omissions, outdated references, interpretation errors, or inconsistencies.

12.3Professional Judgment

Users remain solely responsible for exercising professional judgment, independent verification, and clinical discretion.

Speaker Relationship Disclaimer

13.1Independent Contractors

Speakers engaged by NurseNet operate as independent contractors and are not employees, representatives, subsidiaries, or affiliates of NurseNet unless explicitly stated.

13.2External Affiliations

Any external organizations, employers, institutions, brands, or affiliations connected to Speakers are independent from NurseNet.

13.3Speaker Opinions

Opinions, examples, interpretations, or educational viewpoints expressed by Speakers are their own and do not necessarily reflect the views of NurseNet.

Support and Communication Policy

14.1Support Channel

Official support communications shall be handled primarily through email correspondence.

14.2Support Timeline

NurseNet aims to respond to support enquiries within twenty-four (24) to forty-eight (48) hours during operational business periods.

14.3No Guaranteed Resolution Timeline

Response targets are operational estimates and do not constitute guaranteed resolution timelines.

Limitation of Liability

15.1Educational Use

All Platform content is provided for educational purposes only and shall not constitute medical advice, legal advice, clinical instruction, diagnosis, or guaranteed professional guidance.

15.2Clinical Responsibility

Users remain fully responsible for their own professional decisions, patient care actions, clinical judgment, workplace conduct, and regulatory compliance.

15.3Exclusion of Liability

To the fullest extent permitted under applicable law, NurseNet shall not be liable for indirect, incidental, consequential, punitive, reputational, professional, educational, financial, or operational losses arising from use of the Platform.

Platform Availability and Technical Operations

16.1Availability

NurseNet does not guarantee uninterrupted access, continuous uptime, or error-free operation of the Platform.

16.2Maintenance and Interruptions

The Platform may experience interruptions arising from maintenance, upgrades, technical failures, third-party providers, cybersecurity incidents, or operational requirements.

Termination and Enforcement

17.1Right to Restrict Access

NurseNet reserves the right to suspend, terminate, limit, or permanently revoke access to any User for violations of these Terms.

17.2Grounds for Enforcement

Grounds may include fraud, abuse, harassment, impersonation, intellectual property infringement, certificate misuse, unlawful conduct, platform manipulation, or reputational harm.

Governing Law and Jurisdiction

18.1Applicable Law

These Terms shall be governed by and interpreted in accordance with the laws of Malaysia.

18.2Jurisdiction

Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

Amendments and Updates

19.1Right to Amend

NurseNet reserves the right to amend, revise, modify, replace, or update these Terms at any time without prior notice.

19.2Continued Usage

Continued access to or use of the Platform following updates constitutes acceptance of the revised Terms.
